While my gut wants to side with MS on this one, there's a simple test of whether App Store is generic or not.
Before apple created the App Store within iTunes, was the term in use (and specifically "app store", not just "app")? Possibly more importantly, before they applied for the trademark was any company selling apps and calling it by that term?
It probably comes down to prior art - if it truly is a generic term, then someone should be able to provide the example of X used the term in 19XX, before the trademark was filed. Anyone here able to provide an example of the term being used before Apple filed for it?

Good, my iMac G4 began to act its age � but really only with PS3 � a couple of months ago. I plan to again max out the processor, memory and harddrive upgrades and get another 7.5 years out of this next one.

Clovertown (~November 2006) might be a build to order high end option for Mac Pro as opposed to taking the entire line to 8 cores since there are limitations with that approach including higher power consumption and higher heat output.
Tigerton (Q3 2007 ~summer 2007) is slated to be a true multi-core (quad cores in a single multi-chip module) followup to Woodcrest/Clovertown. It will also use a new platform (Caneland platform comprised of Tigerton/Dunnington and the Clarksboro chipset) which includes a higher performance dedicated high-speed interconnect that gives each processor a direct pathway to the chipset and is supposed to be much faster than the current front-side bus technology. The timing (WWDC 2007) sounds more likely for a major Mac Pro refresh where it does 8 core across the line (and Leopard will probably have a lot more optimization for that many cores).

I agree 100% with the sentiment of what you're saying -- I think the matte vs. gloss thing is WAAAAY overblown, but just for argument's sake, remember that CRT have a curved front screen, not a flat sheet of glass. That's going to diffuse a lot of external light just by the nature of the design.
Sure, maybe, but I remember not being able to even see what was on glass tube CRT monitor when the shades were open. Heck, TVs in summer ? :eek: While there may be virtues to the matte screens, I doubt it's as big an issue as some people make it out to be.

I pity the children of the future when I think back to how I am my friends used to swap Video's, CD's and Computer games with each other, as we only had enough Birthday/Christmas money to afford to buy so much, so we had great fun and enjoyment swapping what we had between friends.
In the same way my elderly mother goes to her weekly meeting and they all bring books they have read in, so others can read their books when they have finished with them. Not everyone can afford to buy new every time.
you are focusing too much on the physical items. maybe bc i like to live simple/minimal....but nowadays too many people want so many physical possessions. to me, less is more.....

Then what is the problem here? You want Apple to announce new products "on time" and tell in advance when they are doing it. But you obviously are not interested in their laptops since "they suck". So why are you so concerned about this again?

Co-branding is a better idea because yes, unless they make a camera that would take Canon or Nikon lenses on their own it would be a failure as a pro tool.

saw a post on ilounge earlier.... that said this guy went to his local apple store, and they said to wait until next week (the 5th) because imacs and mac minis would have core 2 duos.

hmmm works fine for me :) Took a while longer to load on the iPod (had ablack screen for about 5 secs) but plays fine.OK Please play on computer and get info - Command i - while playing to know for certain it is 640x480 H.264. On the bottom it says Normal Size: What numbers are there? In Format: it will say H.264 if it was encoded that way. Also what is the FPS Number playing? Should be 30.

Miles you make a great point... You also confirm that Apple better pull them, its a pointless app because if your so drunk then you can't operate a phone let alone an app.
Who said this app was exclusively for drunks avoiding the cops? I have never been, nor ever plan to be, drunk, but I'd choose to avoid the cops just because I dislike the stress of driving anywhere near them.
Do a poll macrumors.... Us 6 want them pulled Now!!... the others not quoted want them to stay on the App Store for no real good or beneficial reason

Curious that everyone is clamoring for a thunderbolt-enabled machine, but there isn't a single thunderbolt drive available on the market.

That might be so. But Apple has lots of questionable patents as well. Is the Click-wheel REALLY an innovation worth patenting? "We have a wheel, and we have buttons. Why not conbine them?". Or if they want the simple satisfaction of having a C2D laptop on order, they can always pre-order one at Dell, HP, etc., then cancel that pre-order when the MBP C2D are announced. That way, in spirit, they can have a mac Core 2 Duo machine on pre-order right now. :)

The only things I'd like to add is that $100 million is a drop in the bucket for Apple. Apple has $10 billion in cash. That money isn't stuffed in Steve Jobs' mattress, it's being invested in short-term investment vehicles that is producing a good return. Even if Apple stuck it in a plain ol' savings account, the $10 billion would be generating around $300 million a year in interest alone, never mind the fact that Apple is adding $3 billion a year to their cash horde.
Secondly, Apple has sold billions of dollars of iPods over the years. It will sell untold billions of dollars more into the future.
For Creative to settle for a mere $100 million when the iPod is virtually guaranteed to generate tens of billions of dollars going forward is sheer lunancy if Creative was really confident about winning.
In fact, the fact that they settled for such a small sum shows that Creative was sweating bullets about losing it all. Apple was the one dictating the terms here.
